Terms of Service

“RoomKhojo”, “we”, “us”, or “our” refers to the operators of the RoomKhojo website and related services (the “Service”). The Service helps users discover and publish housing-related listings (for example PG, rooms, and flatmate needs) and connect with other users.

By accessing or using the Service, creating an account, or posting content, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; the “Last updated” date at the top will change when we do. Continued use after changes means you accept the revised Terms.

You must be at least 18 years old (or the age of majority where you live) to use the Service. You represent that the information you provide is accurate and that you have the right to enter into these Terms.

Accounts may be provided through a third-party authentication provider (for example Clerk). Your use of that provider is also subject to their terms and privacy policy. You are responsible for safeguarding your account and for all activity under your account.

You may submit listings, messages, images, profile information, and other content (“User Content”). You agree that:

• You own or have the rights needed to post your User Content.
• Your listings are truthful to the best of your knowledge, including rent, location, availability, and photos.
• You will not post illegal, fraudulent, harassing, hateful, sexually explicit involving minors, or malware content.
• You will not scrape, overload, or attempt to disrupt the Service.

RoomKhojo is a technology platform that facilitates discovery and contact between users. We are not a real-estate broker, landlord, PG operator, or party to any lease or agreement between users. Any transaction is strictly between you and the other user.

Users may choose to communicate outside the Service (for example via WhatsApp). Those channels are governed by their respective providers’ terms and policies. We do not control and are not responsible for third-party services.

Core features of the Service may be offered without charge, but we reserve the right to introduce optional paid features in the future with reasonable notice where required by law.

We may remove or restrict User Content, suspend or terminate accounts, or block access if we reasonably believe there is a violation of these Terms, risk to users, or legal requirement. You may stop using the Service at any time.

The Service, branding, and original materials are owned by us or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, revocable licence to use the Service for personal, non-commercial purposes. You retain rights in your User Content, but you grant us a worldwide, non-exclusive licence to host, display, and distribute your User Content as needed to operate and promote the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, COMPLETE, SAFE, OR LEGAL, OR THAT USERS ARE WHO THEY CLAIM TO BE. ALWAYS VERIFY LISTINGS AND MEET IN SAFE CONDITIONS BEFORE PAYING OR MOVING IN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR DEALINGS WITH OTHER USERS. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) INR 500, IF YOU HAVE NOT PAID US.

You will defend and indemnify us and our affiliates, officers, and volunteers against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts at New Delhi, India, shall have exclusive jurisdiction, subject to any mandatory consumer protections where you reside.
